29 CFR  1910.26(d): Measures, such as wheel chocks or sand shoes, are used to prevent the transport vehicle (e.g. a truck, semi-trailer, trailer, or rail car) on which a dockboard is placed, from moving while employees are on the dockboard.  At the establishment located at 2980 South Oakwood Road, Oshkosh, Wisconsin; the employer did not ensure that measures, such as dock locks or wheel chocks, were used to prevent a semi-trailer on which a dock leveler was placed from moving during loading or unloading operations, exposing employees to caught between or under and fall hazards in the following instances:  a. On or about and at times prior to January 27, 2023, at the Shipping and Receiving docks, employees entered semi-trailers while operating forklifts without a means to prevent the semi-trailer from moving. b. On or about January 27, 2023, at Dock 7, an employee entered a semi-trailer that was connected to a truck while operating a CAT forklift (Model: C5000-LP, SN: AT9020253) without a means to prevent the semi-trailer from moving. The truck that was connected to the semi-trailer was idling with the driver seated behind the wheel.

29 CFR  1910.147(c)(7)(iii)(A): Retraining shall be provided for all authorized and affected employees whenever there is a change in their job assignments, a change in machines, equipment or processes that present a new hazard, or when there is a change in the energy control procedures.  At the establishment located at 2980 South Oakwood Road, Oshkosh, Wisconsin; the employer did not ensure that employees engaged in maintenance and servicing activities on equipment, such as but not limited to the Baler (Model 203-101, SN 270E) and Shredder (Model 4F7-5048BAC, SN 040638A), were trained on the updated Lockout/Tagout Posted Procedures, exposing employees to hazardous energies, such as but not limited to electrical and hydraulic.

29 CFR  1910.146(c)(2):If the workplace contains permit spaces, the employer shall inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces. NOTE: A sign reading DANGER -- PERMIT-REQUIRED CONFINED SPACE, DO NOT ENTER or using other similar language would satisfy the requirement for a sign.  On or about January 27, 2023, at the establishment located at 2980 South Oakwood Road, Oshkosh, Wisconsin; the employer did not ensure that exposed employees were informed by posting danger signs or by any other equally effective means, of the existence and location of the danger posed by permit-required confined spaces, exposing employees to the hazards associated with permit required confined spaces, such as but not limited to electrical, hydraulic, and mechanical in the following instances:  a) Entrances into the Baler were not posted as a permit-required confined space. b) Entrances into the Shredder were not posted as a permit-required confined space.

29 CFR  1910.178(a)(5): If the truck is equipped with front-end attachments other than factory installed attachments, the user shall request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered.  On or about January 27, 2023, at the establishment located at facility located at 2980 South Oakwood Road, Oshkosh, Wisconsin; the employer did not ensure that Forklift A (Mfr: Caterpillar, Model: GC40KS1, SN: AT87A01355) was marked to identify the front-end clamp attachment and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered.
