29 CFR 1926.651(k)(2):Where the competent person finds evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees shall be removed from the hazardous area until the necessary precautions have been taken to ensure their safety. On or about January 19, 2023, the competent person failed to remove an employee from the hazards associated with working in and around an unprotected trench, exposing the employee to struck-by hazards. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.652(e)(2)(i):Excavation of material to a level no greater than 2 feet (.61 m) below the bottom of the members of a support system shall be permitted, but only if the system is designed to resist the forces calculated for the full depth of the trench, and there are no indications while the trench is open of a possible loss of soil from behind or below the bottom of the support system. On or about January 19, 2023, a support system (trench box) was used where the bottom member of the trench box was approximately four feet above the bottom of the 8.8 foot deep trench, exposing an employee to struck-by hazards. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.652(a)(1):Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: On or about January 19, 2023, an employee was not protected by a protective system while working in a trench at a depth of 8.8 feet, exposing employees to struck-by hazards associated with a cave-in. Mauro Sewer Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.652(a)(1), which was contained in OSHA inspection number 1500388 , citation number 2 item number 1 and was affirmed as a final order on March 29, 2021, with respect to a workplace located at Cherry St. And Wisner St. Park Ridge, IL 60068. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
