On or about February 6, 2023, employees were using a "sump pump" to remove access water from an excavation that power cord was missing a grounding pin and the pump was not double insulated.

29 CFR 1926.651(g)(1)(i): Where oxygen deficiency (atmospheres containing less than 19.5 percent oxygen) or a hazardous atmosphere exists or could reasonably be expected to exist, such as in excavations in landfill areas or excavations in areas where hazardous substances are stored nearby, the atmospheres in the excavation shall be tested before employees enter excavations greater than 4 feet (1.22 m) in depth. On or about February 6, 2023, employees were preparing an excavation for boring tasks in a trench greater than five feet in depth where a possible hazardous atmosphere existed. The atmosphere in the excavation was not tested before allowing employees to enter the excavation.
