29 CFR  1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface were not used:   Instances including, but not limited to, the following:  a) Job site, 1829 East Railroad Street, Heidelberg, PA: On or about March 1, 2023, during construction activities, the employer did not ensure that there was a safe way to get on/of the ladder jack scaffold, in that the picks were set on the outside of the ladders, causing at least one employee to climb over the pick, exposing him to fall hazards of up to at least approximately 15 feet.

29 CFR  1926.451(f)(3): Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity:    a) Job site, 1829 East Railroad Street, Heidelberg, PA: On or about March 1, 2023, during construction activities, the employer did not ensure that the ladder jack scaffold was inspected for safety issues. Deficiencies noted during the inspection included, but were not limited to, failing to provide a safe way on/off the scaffold, not using fall protection while working on it at heights of over 10 feet, having the ladder jack set up too close to a service drop system and using ladders that had illegible/worn out/marred labels, no ropes for pulleys and at least one ladder that had a broken rung to support the ladder jack scaffold.

29 CFR  1926.451(f)(6): The clearance between scaffolds and power lines did not comply with minimum OSHA safety standard requirements:   a) Job site, 1829 East Railroad Street, Heidelberg, PA: On or about March 1, 2023, during construction activities, the employer did not ensure that the ladder jack scaffold was complaint with minimum federal safety standards in that it was determined to be within 3 feet of the electrical service drop that for the home both at the front and rear of the property.

29 CFR  1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system:    a) Job site, 1829 East Railroad Street, Heidelberg, PA: On or about March 1, 2023, during construction activities, the employer did not ensure that appropriate fall protection systems/devices were in use while employees worked on a ladder jack scaffold where fall hazards of at least up to approximately 15 feet existed.
