29 CFR  1910.303(f)(2):  Each service, feeder, and branch circuit, at its disconnecting means or overcurrent device, was not legibly marked to indicate its purpose, nor located and arranged so the purpose was evident:  On or about March 2, 2023, and at times prior thereto, in the production canning area, a bank of electrical disconnects were not identified as to their purpose.  The Rio Valley Canning Company was previously cited for a violation of this occupational safety and health standard, or its equivalent standard, 29 CFR 1910.303(f)(2), which was contained in OSHA inspection number 1338850, citation number 1, item number 3/a, and was affirmed as a final order on November 7, 2019, with respect to a workplace located at 225 S 13th Street, Donna, Texas.

29 CFR  1904.41(a)(2):  The employer had between 20 and 249 employees at any one time during the previous calendar year, is required to keep records, and, did not electronically submit information from OSHA Form 300A no later than the date listed in paragraph (c) of this section of the year after the calendar year covered by the forms:  Rio Valley Canning Company located at 225 South 13th Street, Donna, Texas:  On or about March 2, 2023, the employer failed during calendar year 2023, to electronically submit information from their OSHA Form 300A or equivalent by 03/02/2023  The establishment employed 50 employees and is classified as NAICS 311421 during calendar year 2022.

29 CFR  1904.39(a)(2):  The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye:  On or about February 10, 2023, at this establishment, an employee in the process of cleaning the labeling machine suffered a crushing hand injury resulting in an in-patient hospitalization.  The employer did not notify OSHA of the in-patient hospitalization within the 24-hour required time period.
