29 CFR  1926.453(b)(2)(v): A body belt (harness) was worn and a lanyard was not attached to the boom or basket when working from an aerial lift:  a)  On or about 03/09/2023,  during the new construction of the  BJ's Restaurant and Brewhouse, located at 760 Jefferson Road, Rochester, New York, the employer did not enforce the use of  fall protection for employees working in the basket of an aerial boom lift, 14 feet above lower levels.  Employees were allowed to work in an articulating boom without the proper use of Personal Fall Arrest Systems such as "tying off"  to the boom basket.    NO ABATEMENT CERTIFICATION REQUIRED

Employees were allowed to work along unprotected sides 16 feet above lower levels without fall protection and were exposed to fall hazards.  NO ABATEMENT CERTIFICATION REQUIRED
