29 CFR 1926.453(b)(2)(v): A body belt (harness) was worn and a lanyard was not attached to the boom or basket when working from an aerial lift: a) On or about 03/09/2023, during the new construction of the BJ's Restaurant and Brewhouse, located at 760 Jefferson Road, Rochester, New York, the employer did not enforce the use of fall protection for employees working in the basket of an aerial boom lift, 14 feet above lower levels. Employees were allowed to work in an articulating boom without the proper use of Personal Fall Arrest Systems such as "tying off" to the boom basket. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(1):"Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) On or about 03/09/2023, during the new construction of the BJ's Restaurant and Brewhouse, located at 760 Jefferson Road, in Rochester, New York, the employer did not enforce the use of fall protection when employees were constructing the building framework. Employees were allowed to work along unprotected sides 16 feet above lower levels without fall protection and were exposed to fall hazards. NO ABATEMENT CERTIFICATION REQUIRED
