29 CFR 1926.1204(c): The employer did not develop and implement the means, procedures, and practices necessary for safe permit space entry operations, including, but not limited to, (c)(1) through (c)(8):  At 143 Congress Street, Worcester MA: On 17 March 2023, and times prior, the employer did not establish and implement a permitted confined-space program prior to conducting sandblasting and painting inside of a municipal water tank during a renovation project.

Employees entered a municipal water tower to perform interior repair/renovation.

Periodic monitoring was not used during the course of entry operations either.  At 143 Congress Street, Worcester MA: On 17 March 2023, and times prior, the employer did not continually evaluate atmospheric conditions throughout, after introducing hazardous chemicals inside of the water tank during sealing operations using Methyl Ethyl Ketone and Elasto Shield TG Black.

29 CFR  1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact.   On 17 March 2023, and times prior, the employer did not ensure that employees were wearing chemical-resistant protective gloves as required by the Safety Data Sheets for Methyl Ethyl Ketone and Elasto-Shield TG Paint Sealant.  An inadequate type of nitrile glove was used to protect employees from Elasto Shield TG Black due to the strong adhesive properties which caused physical tearing of the provided gloves.
