29 CFR 1910.95(g)(1):The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels: (a) Warehouse- On or about March 22, 2023, a machine helper was exposed to continuous noise at 75.6% of the permissible exposure limit (8-hour time weighted average sound level of 85 dBA) or an equivalent sound level of approximately 88 dBA during the 450 min sampling period. (b) Warehouse- On or about March 22, 2023, a machine operator was exposed to continuous noise at 94.4% of the permissible exposure limit (8-hour time weighted average sound level of 85 dBA) or an equivalent sound level of approximately 90 dBA during the 459 min sampling period. (c) Warehouse- On or about March 22, 2023, a machine operator was exposed to continuous noise at 84.3% of the permissible exposure limit (8-hour time weighted average sound level of 85 dBA) or an equivalent sound level of approximately 89 dBA during the 454 min sampling period.
