29 CFR  1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a all protection plan which meets the requirements of paragraph (k) of 1926.502.  a.  On or about March 22, 2023 at the jobsite located at 849 W Wisconsin Ave. Oconomowoc, WI 53066, employees were performing roofing work on a single story portion of a two story residential house without the use of fall protection, therefore exposing employees to a fall hazard of 9.3 feet.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   (a) On or about March 22, 2023 at the jobsite located at 849 W Wisconsin Avenue, Oconomowoc, WI 53066 Oconomowoc WI, employees were performing roofing work on the single story portion of a two story residential house without any fall protection in place, thereby exposing the employees to a fall hazard. Employees did not have fall protection training.
