29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: (a) On or about October 17 2023, at the jobsite located at 519 South Street, Oconomowoc WI, an employee was performing clean up on the ground without a hard hat on while other employees were installing shingles on the roof above, exposing the employee to a struck-by hazard.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a all protection plan which meets the requirements of paragraph (k) of 1926.502. (a) On or about October 17, 2023 at the jobsite located at 519 South Street Oconomowoc, WI 53066, employees were performing roofing work on a the second story of a residential building without the use of fall protection, therefore exposing employees to a fall hazard of approximately 20 feet. (b) On or about October 17, 2023 at the jobsite located at 519 South Street Oconomowoc, WI 53066, an employee was performing roofing work on a the first story of a residential building without the use of fall protection, therefore exposing employees to a fall hazard of approximately 11.3 feet. JA Homeworx LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1658290, citation number 1, item number 1 and was affirmed as a final order on 4/18/23, with respect to a workplace located at 849 W. Wisconsin Ave, Oconomowoc WI 53066.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a) On or about October 17, 2023 at the jobsite located at 519 South Street, Oconomowoc, WI 53066 Oconomowoc WI, employees were performing roofing work on the two story portion and single story portion of a two story residential house without any fall protection in place, thereby exposing the employees to a fall hazard. Employees did not have fall protection training. JA Homeworx LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.503(a)(1), which was contained in OSHA inspection number 1658290, citation number 1, item number 2 and was affirmed as a final order on 4/18/23, with respect to a workplace located at 849 W. Wisconsin Ave, Oconomowoc WI 53066.
