OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to crushed-by hazards: a) 4955 S Ulster St., Denver CO, 80237: On or about March 28, 2023, the employer exposed employees to crushing hazards by allowing employees to operate a mini excavator in an unsafe manner. The dozer blade of a CAT 303.5E2 mini excavator (Serial # JWY06269) was used to elevate the rear of the excavator up on a single stack of two blocks of 4x4 lumber in order to be able to dig deeper into the trench beyond the excavator's reach. This caused the excavator to sit at a angle on an unstable stack of lumber. Employees were exposed to crushed-by hazards in the event the equipment fell off of the lumber or tipped over while in operation.

29 CFR 1926.652(c): Support systems, shield systems, and other protective systems were not designed and constructed in accordance with the requirements of paragraph (c)(1-4); a) 4955 S Ulster St., Denver CO, 80237: On or about March 28, 2023, the employer did not provide a protective system constructed in accordance with the requirements of paragraph (c)(1-4) to protect employees from cave-in hazards while working in an excavation 10 feet in length and in excess of 5 feet deep. One section of hydraulic shoring with vertical 4x8 foot fin form panels had been installed in the middle of the trench and no protective system was installed on the ends of the trench.

29 CFR 1904.29(a): The employer did not use an OSHA 300 and 300A Form or equivalent for recordable injuries and illnesses: a) 56800 E 32nd Ave, Strasburg, CO 80136: On or about March 28, 2023, and at times prior, the employer forms used for recording injuries and illnesses were not equivalent forms for the calendar year 2022. The employer provided a workers compensation insurance claim report for 2022. The report was not an OSHA 300 equivalent form in that it did not include case classifications, the number of days away from work or on job transfer or restriction for each injury and illness type, the annual average number of employees, the total hours worked by all employees in the last year, the employee access and employer penalty statements found on the OSHA 300A Summary form, and was not certified by a company executive.
