29 CFR 1910.119(n): The employer did not establish an emergency plan for the entire plant in accordance with the provisions of 29 CFR 1910.38: On or about March 29, 2023, the employer did not ensure the written emergency response plan contained all information required by 29 CFR 1910.38. The written plan did not include specific details on the evacuation routes expected for employees to take on their way to the muster point, specific equipment shutdown procedures for employees to follow prior to evacuation, identification of which employees are responsible for shutting down equipment, the process for accounting for all employees after an evacuation, and the name or title of the employee(s) who may be contacted for more information about the plan. Failure to develop and implement a complete emergency action plan in accordance with 29 CFR 1910.38 can potentially expose employees to fire and inhalation hazards.

29 CFR 1910.1200(f)(6)(i): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the information required by 29 CFR 1910.1200(f)(1)(i) through 29 CFR 1910.1200(f)(1)(v). On or about March 29, 2023, the employer did not ensure that containers storing hazardous chemicals such as, but not limited to potassium hydroxide, sodium hypochlorite, and ammonium chloride which are included in Geron IV and Dyna-Chlor SM were labeled and marked with the product identifier, signal works, hazard statements, pictograms, precautionary statements, and the chemical manufacturer's name, address, and telephone number in that containers in the work area were labeled with the product identifier or as sanitizer.
