29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied: a- 40 Foundry Boulevard, Mount Holly NJ: On or about 03/30/23 the company worksite Foreman was exposed to fall hazards, in excess of 13 feet to the ground surface below, when an all terrain fork truck was used to support an unsecured, wooden pallet that they were working and standing from. This unsecured, wooden pallet was not attached to the fork truck at the time of and prior to the worksite inspection and was moved horizontally while it was occupied. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

At that time the worksite Foreman was not utilizing any fall protection and the unsecured wooden pallet was not provided with guard rails.
