29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) as incorporate by reference under 1926.602(d):  a) 20 Providence Avenue, Lakewood NJ: On or about 03/30/23 the company did not ensure that a company worker who operated a JLG All -Terrain lift  at the worksite had received training which included formal instruction, hands on and an evaluation with a written certification of completion.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied:   a- 40 Foundry Boulevard, Mount Holly NJ: On or about 03/30/23 the company worksite Foreman was exposed to fall hazards, in excess of  13 feet to the ground surface below, when an all terrain fork truck was used to support an unsecured, wooden pallet that they were working and standing from.  This unsecured, wooden pallet was not attached to the fork truck at the time of and prior to the worksite inspection and was moved horizontally while it was occupied.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.   a- 20 Providence Lane, Lakewood NJ: On or about 03/30/23 the company worksite Foreman was exposed to fall hazards, in excess of  13 feet to the ground surface below when working and standing from a unsecured wooden pallet that was set on the elevated forks of an All-terrain fork truck.  At that time the worksite Foreman was not utilizing any fall protection and the unsecured wooden pallet was not provided with guard rails.     NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    a - 20 Providence Avenue, Lakewood NJ:  While engaged in framing and other related activities the company worksite Foreman was exposed to fall hazards, up to and in excess of 15 feet 6 inches to the ground surface below, when walking on and working from the wooden framing of a residential structure's pitched porch roof without the use of fall protection.  Condition noted  on or about 03/30/23.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. 29 CFR  1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii)    a - 20 Providence Avenue, Lakewood NJ:  Workers performing sheathing installation and other related activities at the worksite were not trained on fall protection means and methods as specified in 29 CFR 1926.503(a)(2)(i) through (viii).  On or about 03/30/23 the company worksite Foreman was exposed to fall hazards in excess of 15 feet 6 inches when performing sheathing installation and other related activities while walking and working from a residential structure's porch frame and while standing and working from an unsecured wooden pallet that was not supplied with guardrails as it was set on the elevated forks of an All-terrain fork truck.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
