29 CFR 1926.100(a):  Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:  At the residential construction site, the employer did not provide hard hats to employees performing decking activities. The employees were exposed to the hazard of being struck by falling decking supplies.

At the construction site, the employer did not ensure that employees using a nail gun for decking activities were provided eye protection.  Employees were exposed to being struck by flying objects.

29 CFR 1926.1053(b)(1):  Where portable ladders were used for access to an upper landing surface and the ladder length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.  At the residential construction site, employees accessing the roof on a metal ladder with side rails that did not extend at least 3 feet above the edge of the roof were potentially exposed to fall hazard greater than 11 feet.
