29 CFR 1926.501(c): When employees were exposed to falling objects the employer did not require employees to wear hard hats and did not implement measures to prevent objects from falling from higher levels as set forth in (c)(1)-(3) of this section: a) 352 Whittier Avenue, Syracuse, NY 13204: On or about April 3, 2023, employer failed to ensure employees exposed to falling objects were required to wear hard hats and did not implement measures such as erecting toeboards, screens, or guardrail systems to prevent objects from falling from higher levels; or erect a canopy structure and keep potential fall objects far enough from the edge of the higher level so that those objects would not go over the edge if they were accidentally displaced.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) 352 Whittier Avenue, Syracuse, NY 13204: On or about April 3, 2023, employees were engaged in residential roofing activities. The employer failed to ensure a portable ladder being used by employees to access the roof of a two-story house had the side rails extended 3 feet beyond the access point. E&C Home Improvement, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.1053(b)(1)), which was contained in OSHA inspection number 1546166, citation number 1, item number 2 and was affirmed as a final order on March 2, 2022, with respect to a workplace located at 607 Manlius Street, Fayetteville, NY 13066.
