29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):   a) E&C Home Improvement, Inc., 4925 Windgate Road, Liverpool, NY 13088: On or about 6/6/2023 the employer did not ensure two employees engaged in residential roofing activities on an 6:12 pitch roof with a fall distance of approximately 11 feet, were protected by guardrail systems, safety net systems, or personal fall arrest systems.   E&C Home Improvement, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1546166, citation number 1 item number 1 and was affirmed as a final order on 03/22/2022, with respect to a workplace located at 607 Manlius Street, Fayetteville, NY 13066.  E&C Home Improvement, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1651351, citation number 1 item number 1 and was affirmed as a final order on 04/19/2023, with respect to a workplace located at 506 Allen Road, Syracuse, NY 13219.  E&C Home Improvement, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1660755, citation number 2 item number 1 and was affirmed as a final order on 09/21/2023, with respect to a workplace located at 352 Whittier Avenue, Syracuse, NY 13204.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (0.9 m) above the upper landing surface being accessed:   a) E&C Home Improvement, Inc., 4925 Windgate Road, Liverpool, NY 13088: On or about 06/06/2023, employees were using portable extension ladders for roof access/egress that were not extended 3-feet above the upper landing surface being accessed.  E&C Home Improvement, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.1053(b)(1)), which was contained in OSHA inspection number 1546166, citation number 1, item number 2 and was affirmed as a final order on 03/02/2022, with respect to a workplace located at 607 Manlius Street, Fayetteville, NY 13066.
