29 CFR 1910.119(e)(5): The employer did not establish a system to promptly address the team's findings and recommendations; assure that the recommendations are resolved in a timely manner and that the resolution is documented; document what actions are to be taken; complete actions as soon as possible; develop a written schedule of when these actions are to be completed; communicate the actions to operating, maintenance and other employees whose work assignments are in the process and who may be affected by the recommendations or actions: a) At the Terpene Resin area: On or about 04/15/2023, and at times prior to, the recommended items in the 2018 Process Hazard Analysis (PHA) for the pump to transfer trimethylchlorosilane from cylinder to reactor were not assigned or tracked for completion and communication of the status of the recommendations was not provided to the employees who would be affected by the recommendations or actions.

29 CFR 1910.119(j)(2): The employer did not establish or implement written procedures to maintain the on-going integrity of process equipment: a) At the Terpene Resin area: On or about 04/15/2023, and at times prior to, the employer did not address the failure of engineering controls, in that a procedure or other documented method was not developed and implemented to ensure correct wiring and rotation verification was performed during the installation of the TMCS motor replacement.
