The portable fuel cans were sat across from the fenced entry exposing them to vehicular traffic.

29 CFR  1926.152(c)(3): Storage area(s) for flammable and combustible liquids outside building(s) were not graded in a manner to divert possible spills away from buildings or other exposures and were not surrounded by a curb or earth dike at least 12 inches:  a) Delaware Legislative Hall at 411 Legislative Avenue, Dover, DE 19901: On or about April 25, 2023, CSHO observed employees exposed to portable fuel containers sitting along the roadway where vehicles and equipment continued to drive without any type of protective means to protect employees if a container was to spill or leak. The containers used were not approved and the lack of required fire extinguishing equipment with the mix of stored materials would significantly increase the potential of injury and/or death.

Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.   a) Delaware Legislative Hall at 411 Legislative Avenue, Dover, DE 19901: On or about April 25, 2023, CSHO observed employees performing roofing installation work on the edge of a roof on an existing state building approximately 15 feet above the surface of a scaffold and approximately 40 foot above the ground level.   D.A. Nolt, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(B)(10), which was contained in OSHA inspection number 1549781, citation number 1, item number 1 and was affirmed as a final order on December 6, 2021, with respect to a workplace located at 930 North Street, Meadville, PA 16335.
