29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access. a.) 311 Sip Ave., Jersey City, New Jersey Employees engaged in masonry activities accessed a supported frame scaffold platform by climbing the cross braces, which exposed them to fall hazards of approximately 20 feet, on or about 04/24/2022. Genesis Masonry, LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(e)(1), which was contained in OSHA inspection number 1538843, citation number 1, item number 1 and was affirmed as a final order on 09/28/2021, with respect to a workplace located at 52-56 Cambridge Ave., Jersey City, NJ 07302.

29 CFR 1926.451(g)(1)(vi): Each employee performing overhand bricklaying operations from a supported scaffold was not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity): a.) 311 Sip Ave., Jersey City, New Jersey Employees engaged in masonry activities worked from a Welded Tubular Frame Scaffold that did not have mid-rails, did not have end-rails, and employees had no other means of fall protection. Employees were exposed to fall hazards of approximately 15-feet to the next lowest level, on or about 04/24/2023. Genesis Masonry, LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1)(vi), which was contained in OSHA inspection number 1657406, citation number 1, item number 1, and was affirmed as a final order on 06/21/2022, with respect to a workplace located at 105 Darcy Street, Newark, NJ, 07302.
