29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): (a)CrossCountry Freight Solutions at 1508 Robur Drive in Sioux Falls SD, 57104: On or about and at times prior to April 27, 2023, the employer did not ensure employees were protected from fall hazards in that effective fall protection methods were not implemented to prevent falls to the exterior of the building through open dock doors of the warehouse when trucks were not present. This condition exposed employees to fall hazards of approximately four feet above a lower level.

29 CFR 1910.178(a)(4):Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: (a)CrossCountry Freight Solutions at 1508 Robur Drive in Sioux Falls SD, 57104: On or about and at times prior to April 27, 2023, the employer did not ensure employees were protected from struck-by hazards in that the fork extensions were used in conjunction with forklifts onsite without the manufacturer's prior written approval. This condition exposed employees to struck-by hazards.
