OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards when operating a forklift without the use of a restraint device: 6050 East 56th Avenue, Commerce City CO: On or about May 23, 2025, the employer did not require forklift operators to wear the seatbelts while operating the Mitsubish Forklift (Model #FGC18N, Serial #AF1F45940). This condition exposed employees to struck-by hazards.
