(a) Lodgeville Estates: On or about April 23, 2023, and times prior, an employee was operating a JLG 400S telescopic boom lift and did not connect the body harness to the anchor point in the basket, exposing the employee to a fall of up to 19ft. 4in. to the ground below.

29 CFR 1926.502(d)(21): Personal fall arrest systems were not inspected prior to each use for wear, damage, and other deterioration, and/or defective components were not removed from service. (a) Lodgeville Estates: On or about April 23, 2023, and times prior, the 6ft. lanyards provided by the Employer to be used when operating and/or working in the JLG 400S telescopic boom lift were not inspected prior to use, therefore the rusted/corroded steel snap hooks and the UV damaged lanyards were not removed from service.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b). (a) Lodgeville Estates: On or about April 23, 2023, and times prior, 3 workers were engaged in roofing activities on a two story residential apartment building, 2 employees were on the 5/12 pitched field section of the roof and 1 employee was on the 8/12 pitched middle dormer of the roof, and the fall protection harnesses being worn were not attached to an anchor point exposing the employees to falls of up to 19ft. 4in. to the ground.
