29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   On or about May 2, 2023, employees reinstalling shingles on the roof of a single-story residential building during reroofing, at a height greater than six feet, were not protected from falls to the lower level.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards.  On or about May 2, 2023, the employer did not ensure employees exposed to potential fall hazards had been trained to recognize and minimize the fall hazards associated with their work in that all employees were working from heights greater than six feet without fall protection.

29 CFR  1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about May 2, 2023, employees shingling a multi-level residential roof while using pneumatic nail machines were doing so without the use of eye protection exposing the employees to eye or face hazards from flying particles.
