29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  (a) On or about August 28, 2024, at a jobsite located at 1731 Edgewood Ave, South Milwaukee, WI 53172, employees were operating hand tools to include pneumatic nail guns without  eye protection while installing roof shingles. This exposed employees to struck-by and eye impalement hazards.  Top Quality Roofing LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.102(a)(1), which was contained in OSHA inspection number 1667388, citation number 1, item number 3 and was affirmed as a final order on August 17, 2023, with respect to a workplace located at 18 W Sedgemeadow St, Elkhorn, WI 53121.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a) On or about August 28, 2024, at a jobsite located at 1731 Edgewood Ave, South Milwaukee, WI 53172, employees conducting roofing activities (shingle installation) on a 6:12 pitch roof of the structure were not protected from falling to the lower level. This exposed employees to a fall hazard from the first floor roof of approximately 8 .3 feet on the North side of the structure.  Top Quality Roofing LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1673820, citation number 1, item number 1 and was affirmed as a final order on October 18, 2023, with respect to a workplace located at 24 S Concord Rd, Oconomowoc, WI 53066.  Top Quality Roofing LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1667388, citation number 1, item number 1 and was affirmed as a final order on August 17, 2023, with respect to a workplace located at 18 W Sedgemeadow St, Elkhorn, WI 53121.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  (a) On or about August 28, 2024, at a jobsite located at 1731 Edgewood Ave, South Milwaukee, WI 53172, one of the portable ladders being used to access the roof of the structure did not extend at least three feet above the upper landing area nor was it secured in place. This exposed employees accessing and egressing to and from the roof, to a fall hazard of approximately  8.3 feet onto concrete.  Top Quality Roofing LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1667388, citation number 1, item number 2, and was affirmed as a final order on August 17, 2023, with respect to a workplace located at 18 W Sedgemeadow St, Elkhorn, WI 53121.
