(a) 35 Division Street, Brick, NJ: A worker was not wearing a hard hats/head protection, and was exposed to struck by hazards when working beneath and around other workers who were performing framing and other related activities above them. Observed on or about 01/12/2023. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. (a) 35 Division Street, Brick, NJ: Workers were not wearing eye protection, exposign them to flying particles when working beneath and around other company workers who were performing framing and other related activities, while using hand tools and equipment. Observed on or about 01/12/2023. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) 35 Division Street, Brick NJ: Workers engaged in roofing and other related activities were exposed to fall hazards, up to and more than 11 feet to the ground surface below, when walking on and working on the second floor level of a residential structure without the use of fall protection. Employee fell from the seconf floor level and was injured and had to be transported to the hospital. Condition noted on or about 01/05/2023 (b) 35 Division Street, Brick NJ: Workers engaged in roofing and other related activities were exposed to fall hazards, up to and more than 11 feet to the ground surface below, when walking on and working on the second-floor level of a residential structure without the use of fall protection.
