29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: (a)Woods Roofing, Inc. at 335 West 1st Street Tea, SD, 57064: On or about and at times prior to May 8, 2023, the controlling employer did not ensure subcontractor employees were properly anchored/tied off while performing roofing operations on a commercial property. Subcontracted employees were conducting roofing operations on a 9/12 pitched commercial roof without an adequate fall protection system. This condition exposed employees to fall hazards greater than six feet while conducting roofing operations.

29 CFR 1926.502(d): Personal fall arrest systems and their use did not comply with the provisions set forth in paragraphs (1) through (24) of this section: (a)Woods Roofing, Inc. at 335 West 1st Street Tea, SD, 57064: On or about and at times prior to May 8, 2023, the controlling employer did not ensure that subcontracted employees were using appropriate fall arrest systems while performing roofing operations on a commercial property. Subcontracted employees were utilizing rock climbing equipment while conducting roofing activities in place of fall arrest equipment. This condition exposed subcontractor employees to fall hazards greater than six feet.
