29 CFR 1926.1053(b)(1): The employer did not ensure that where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a)Woods Roofing, Inc at 3505 East 25th Street, Sioux Falls, SD 57103: On or about and at times prior to August 25, 2026, the exposing employer did not ensure that the portable multi use ladder being utilized to access the roof of the residential home was extended at least three feet above the upper landing surface. This condition exposed employees to fall hazards greater than 9 feet.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain effective programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person: (a)Woods Roofing, Inc at 3505 East 25th Street, Sioux Falls, SD 57103: On or about and at times prior to August 25, 2026, the employer did not ensure an effective accident prevention program was developed and implemented for the work environment to include regular inspections of the jobsite, materials, and equipment; conducted by a competent person. Several subcontracted employees were exposed to fall hazards from an improperly adjusted ladder, inadequate fall protective systems, and a lack of eye protection while operating pneumatic nail guns when conducting residential roofing activities. This condition exposed subcontracted employees to various hazards.
