29 CFR 1910.1200(e)(1):The employer did not develop, implement, and maintain at the workplace a written hazard communication program which describes how the criteria specified in paragraphs (f), (g), & (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes items (i) and (ii) of this subparagraph:  a) W 41st Street & E Matson Run Parkway Wilmington, DE 19802: On or about May 10, 2023, the employer supplied gasoline and chain oil, gasoline which is a skin corrosion/irritant  to be used at the worksite, and while doing so did not provide or maintain a hazardous communication program to include labels and other forms of warning, safety data sheets, and employee information and training as required.

Employees were exposed to multiple hazards onsite including but not limited to struck by/caught in hazards when they performed tree cutting work.  b) West Street & E Matson Run Parkway Wilmington, DE 19802: On or about May 10, 2023, the employer failed to provide signs visible to the public while traveling on West Street to assist traffic in understanding traffic pattern changes due to tree cutting work. Employees were exposed to multiple hazards onsite including but not limited to struck by/caught in hazards when they performed tree cutting work.

29 CFR 1926.200(g)(2): The design and use of all traffic devices, including signs, signals, markings, barricades, and other devices, for protection of construction workers did not conform to Part 6 of the MUTCD (incorporated by reference, see 1926.6):  a) W 41st Street & E Matson Run Parkway Wilmington, DE 19802: On or about May 10, 2023, employees were exposed to multiple hazards onsite including but not limited to struck-by and caught-in hazards when those employees performed tree cutting activities without properly displayed temporary roadway closure signage. The employer failed to ensure that employees were provided proper roadway signage as stated in the MUTCD Section 6G.03.
