29 CFR 1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. (a) On or about May 10, 2023, at the jobsite located at 827 Marymere Drive, Oconomowoc, WI 53066, three employees were installing underlayment paper and new shingles on the one-story section of a two-story home without the use of fall protection, exposing employees to a fall hazard between approximately seven to eight and a half feet. Residential Roofing LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1572879, citation number 1, item number 1 and was affirmed as a final order on May 2, 2022, with respect to a workplace located at 231 Four Winds Ct., Hartland, WI 53029.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access. (a) On or about May 10, 2023, at the jobsite located at 827 Marymere Drive, Oconomowoc, WI 53066, employer did not ensure at least one of the extension ladders on site were extended a minimum of three feet above the roof eave that employees were using to access the roof, exposing employees to a fall hazard between approximately seven to eight and a half feet.
