29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:  a)New automated brake press area; On or about May 8, 2023: the employer exposed employees to potential hazardous energies in that employees were required to work on equipment to include but not limited to the new automated brake press which had multiple energy sources such as electric, pneumatic and hydraulic without those employees being required to utilize machine specific lock out procedure(s) to ensure that those energy sources were controlled while the employees were performing maintenance, cleaning, or servicing on the machine(s).  b)Mixing area; On or about May 8, 2023: the employer exposed employees to potential hazardous energies in that employees were required to work on equipment to include but not limited to the new mixer which had multiple energy sources such as electric, pneumatic and hydraulic without those employees being required to utilize machine specific lock out procedure(s) to ensure that those energy sources were controlled while the employees were performing maintenance, cleaning, or servicing on the machine(s).  c)Mixing area; On or about May 8, 2023: the employer exposed employees to potential hazardous energies in that employees were required to work on equipment to include but not limited to the old mixer which had multiple energy sources such as electric, pneumatic and hydraulic without those employees being required to utilize machine specific lock out procedure(s) to ensure that those energy sources were controlled while the employees were performing maintenance, cleaning, or servicing on the machine(s).

29 CFR  1910.147(c)(6)(i):The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed:  a)  Facility; On or about May 8, 2023: the employer exposed employees to potential hazardous energies in that the employer failed to conduct the required periodic inspection of the energy control procedures for machinery with multiple energy sources which includes but is not limited to mixers and brake press machines. Employees were required to work on these machines with procedures that had not been audited periodically as required by the standard so that any deviations or inadequacies would be discovered and corrected.
