29 CFR 1910.212(a)(2):General requirements for machine guards. Guards were not affixed to the machine where possible and secured elsewhere if for any reason attachment to the machine was not possible. The guard was not such that it did not offer an accident hazard in itself. At 11722 Northline Industrial Drive, Maryland Heights, on May 19, 2023, and at times prior thereto Employees of MB Sturgis were exposed to a Quality Quest Crimping Machine model number IM-2-STD-120V which did not have a guard to prevent employee's fingers from entering the area where crimping occurred.

29 CFR 1910.212(a)(3)(ii):The point of operation of machines whose operation exposes an employee to injury, was not guarded. The guarding device was not in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, was not so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle. At 11722 Northline Industrial Drive, Maryland Heights, on May 19, 2023, and at times prior thereto Employees of MB Sturgis were exposed to a Pull Tester Machine which was able to operate with the guard cover open, allowing employees body parts to be in close proximity to moving machine parts.
