29 CFR 1926.651(i)(3): Sidewalks, pavements, and appurtenant structure were undermined where no support system or another method of protection was provided to protect employees from the possible collapse of such structures:  (a) On May 24, 2023, near 1913 Gateway Drive in Grand Forks, North Dakota, employees working in the east trench, 11 feet in depth, were installing water lines where sidewall failure (partial collapse) created a void directly below an existing sidewalk. Braces or other means to support the sidewalk were not installed.

(b) On May 24, 2023,  near 1913 Gateway Drive in Grand Forks, North Dakota, employees installing water lines in the middle trench, 10 feet in depth were not protected from vertical trench walls.  (c) On May 24, 2023,  near 1913 Gateway Drive in Grand Forks, North Dakota, employees installing water lines in the east trench, 11 feet in depth were not protected from vertical trench walls.  Taggart Contracting, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.651(k)(2), which was contained in OSHA inspection number 1342294, citation number 1, item number 1b and was affirmed as a final order on October 01, 2018, with respect to a workplace located at the corner of Eighth Street North & University Avenue, Grand Forks, ND.
