Overhead hazards include suspended loads form materials being lowered into the trench, a suspended 6 inch gas line and steel I beams, makeshift shoring, and debris along the edge of the excavation.

29 CFR  1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).  Taggart Contracting, Inc. is failing to protect each employee performing work in trenches by properly sloping or benching the trenches or using appropriate protective systems designed in accordance with paragraph (b) or (c) of 29 CFR 1926.652.  These violations were committed on or about July 10, 2025, and at times prior to that date, where employees were exposed to cave-in hazards while installing force main lines in an excavation greater than five feet in depth without adequate protective systems in place. To abate this violation, the employer must ensure that its trenches and excavations are properly sloped, benched, or equipped with appropriate protective systems, and that no employees enter trenches and excavations until this protection is provided.  (a) At or near 11th Avenue S & Vail Circle, Pump Station 186, Grand Forks , North Dakota, employees were exposed to cave-in hazards while working near the north end of the excavation, which was greater than 5 feet in depth,  with a makeshift shoring system that was not constructed in accordance with established tabulated data or approved by a registered professional engineer.  (b)  At or near 11th Avenue S & Vail Circle, Pump Station 186, Grand Forks , North Dakota, employees were exposed to cave-in hazards while working near the exposed gas line along the eastside of the excavation, which was greater than 5 feet in depth, with exposed near vertical walls.  Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1672454, Citation 2, Item 2, and was affirmed as a final order on March 6, 2024, with respect to a workplace located at 1913 Gateway Drive, Grand Forks, ND 58203.
