29 CFR  1926.302(b)(5):The manufacturer's safe operating pressure for hoses, pipes, valves, filters, and other fittings were exceeded.  Roof: On or about 5/25/2023, and at times prior, the employer exposed an employee to struck-by hazards, in that they were operating a Metabo pneumatic nail gun at 140 psi without eye protection while performing framing activities. The maximum range for the nail gun was 120 psi.

29 CFR  1926.102(a)(1):Employees did not use eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  Roof: On or about 5/25/2023 and at times prior, the employer exposed employees to struck-by hazards, in that they were operating a Metabo pneumatic nail gun at 140 psi without eye protection while performing framing activities.  Construction Landaverde, LLC was previously cited for a violation of this Occupational Safety and Health Standard 1926.102(a)(1), which was contained in OSHA inspection number 1662416, citation number 1, item number 1 and was affirmed as a final order on 5/17/2023, with respect to a workplace located at The Pines at Ashton Place, 82 Pine Haven Drive, Lot 7, Newnan, Georgia 30265.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    (a) Front Roof Area: On or about 5/25/2023, the employer exposed employees to fall hazards of 16 feet above ground level, in that a fall protection system was not provided while the employee was on a 10:12 pitch roof framing a residential home.  Construction Landaverde, LLC was previously cited for a violation of this Occupational Safety and Health Standard 1926.501(b)(13), which was contained in OSHA inspection number 1662416, citation number 1, item number 2b and was affirmed as a final order on 5/17/2023, with respect to a workplace located at The Pines at Ashton Place, 82 Pine Haven Drive, Lot 7, Newnan, Georgia 30265.
