29 CFR 1910.22(c): The employer did not provide, and ensure each employee uses, a safe means of access and egress to and from walking-working surfaces. (a) On or about June 1, 2023, an employee accessed and egressed the top of a pergola by climbing the forklift mast and stepping on a wood pallet placed on the forks of the forklift. This exposed the employee to a fall hazard of approximately 10 to the ground below. (b) On or about June 1, 2023, employees were exposed to a fall hazard while using an unsafe means to access and egress the top of a decorative pergola at approximately 10 feet above the ground level. Employees used a forklift with a wood pallet placed on the forks of the forklift and were elevated and lowered while standing on the wood pallet to access and egress the top of the pergola.

29 CFR 1910.27(a): The employer did not ensure that scaffolds used in general industry meet the requirements in 29 CFR part 1926, subpart L (Scaffolds). (a) On or about June 1, 2023, employees who were elevated on a wood pallet by a forklift to perform work, were not protected from falling. This exposed employees to a fall hazard of approximately 10 feet to the ground below. (b) On or about June 1, 2023, a wood pallet placed on the forks of a forklift to elevate employees to an elevated work surface was not attached to the forklift to prevent displacement.

(b) On or about June 1, 2023, employees were planting flowers on top of a roof overhang at the entrance to the indoor shop without the use of fall protection. This exposed employees to a fall hazard of approximately 12 feet to the ground below.

29 CFR 1910.178(m)(5)(iii): Powered industrial truck(s), with the operator dismounted and within 25 feet of the truck still in his view, did not have forks lowered or parking brakes engaged. (a): On or about June 1, 2023, at the front entrance to the indoor shop, the authorized operator of the forklift left the Toyota forklift unattended while the forks were raised. The authorized operator left the controls of the forklift with the forks raised over 10 feet to access and egress the top of a pergola by climbing the forklift mast and stepping on a wood pallet placed on the forks of the forklift.
