29 CFR  1926.416(a)(1): The employer did not prevent employee(s) from working in proximity to an electric power circuit that the employee could contact during the course of work and the employee(s) were not protected against electric shock by de-energizing the circuit and grounding it or by guarding it effectively by insulation or other means:  a) 5106 Bear Road, Syracuse, NY 13212:  On or about 06/02/2023, the employer did not protect employee(s) from possible electrical shock when roofers were using multiple tools, including but not limited to a pneumatic nail guns, hammers and a ladder around incoming 240-Volt electrical lines.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a) 5106 Bear Road, Syracuse, NY 13212:  On or about 06/02/2023, employer did not ensure employees engaged in residential construction activities on a one-story house, with a roof pitch of approximately 8:12 and a fall distance of greater than 6 feet, were protected by guardrail systems, safety net systems, or personal fall arrest systems.  b) 5106 Bear Road, Syracuse, NY 13212:  On or about 06/02/2023, employer did not ensure employees engaged in residential construction activities on a one-story house, with a roof pitch of approximately 2:12 and 3:12 and fall distance of greater than 6 feet, were protected by guardrail systems, safety net systems, personal fall arrest systems or a monitoring system.  J & L Construction 1 Corp was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.501(b)(13)), which was contained in OSHA inspection number 1634921, citation number 1, item number 1 and was affirmed as a final order on August 11, 2023, with respect to a workplace located at 715 Second Street, Solvay, NY 13209.  J & L Construction 1 Corp was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.501(b)(10)), which was contained in OSHA inspection number 1620907, citation number 1, item number 1 and was affirmed as a final order on October 18, 2022, with respect to a workplace located at 84 Gates Manor Drive, Rochester, NY 14606.
