29 CFR  1926.100(a):  Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  (a)  On or about June 12, 2023, at the above addressed jobsite, employees performing residential framing operations were not wearing protective helmets, to protect against falling materials and debris.

29 CFR  1926.102(a)(1):  The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) On or about June 12, 2023, at the above addressed jobsite, an employee using a skill saw, did not wear safety glasses, thereby exposing the employee to the hazards associated with eye injuries.

29 CFR  1926.251(e)(8):  Synthetic web slings were not immediately removed from service if any of the following conditions specified in 1926.251(e)(8)(i) through (e)(8)(v) were present:  (i) Acid or caustic burns; (ii) Melting or charring of any part of the sling surface; (iii) snags, punctures, tears, or cuts; (iv) broken or worn stitches; or (v) distortion of fittings.  (a)  On or about June 12, 2023, at the above addressed jobsite, synthetic web slings which had snags, tears and worn or broken stitches were used to lift a section of framing into place on the second story.

29 CFR  1926.501(b)(13):  Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a)  On or about June 12, 2023, at the above addressed jobsite, employees performing residential carpentry operations working on a second level at approximately fourteen (14) feet with lack of guardrails were not protected from falls, thereby exposing the employee to fall hazards.  (b)  On or about June 12, 2023, at the above addressed jobsite, an employee performing residential carpentry operations working on a second level at approximately seventeen (17) feet with lack of guardrails was not protected from falls, thereby exposing the employee to fall hazards.  Legendary Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1385208, citation number 2, item number 2, and was affirmed as a final order on November 12, 2020, with respect to a workplace located at Lot 122 Tullamore Lane, Lemont, Illinois.
