29 CFR 1926.651(j)(2): Employees shall be protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection shall be provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. a) On or about 06/15/2023, during a water main break repair project along the 1600 block of Dewey Avenue, in Rochester, New York, the employer did not enforce protective measures to prevent equipment Bodenverdichter - Tamper machine, Type: CR 5-11Hd, located 16 inches from the edge of the trench wall, from falling into the excavation. Employees were allowed to work in an excavated trench measuring 9ft 10 inches deep repairing and replacing a main water line and they were exposed to struck by hazards. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c). a) On or about 06/15/2023, during a water main break repair project along the 1600 block of Dewey Avenue, located in Rochester, New York, the employer did not enforce the use of cave-in protection for employees working in a trench 9 feet 6 inches below grade. Employees were allowed to repair and install replacement water mains inside a trench with no protective systems in place. NO ABATEMENT CERTIFICATION REQUIRED
