29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following: Guardrail systems; Safety net systems; or Personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems: a) Laurel Valley Farms located at 705 Penn Green Road, Landenberg, PA 19350 - On or about June 16, 2023, the employer did not ensure that an employee working adjacent to unprotected edges was protected from falls by the use of guardrail system, safety net system, or personal fall protection system. An employee was required to ride a conveyer belt and perform work in the spinner box without the use of fall protection, thereby exposing the employee to falls approximately 4 to 28 feet from the ground level.

The spinner box was energized with an employee working in it, exposing the employee to caught-in between hazards.

The spinner box was energized after the lockout device was removed without notification to the affected employee working in it, exposing the employee to caught-in between hazards.
