29 CFR 1926.501(b)(1):Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a.) DH Steel Products, LLC, 1128 State Street, Erie, PA - On or about 6/16/23, employees were torch cutting on metal decking with a fall hazards of approximately 10-feet. The employees were not utilizing fall protection while exposed to fall hazards. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation. This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement. IN ADDITION, abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic, or video evidence or abatement or other written records.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a.) DH Steel Products, LLC, 1128 State Street, Erie, PA - On or about 6/16/23, employees were torch cutting on metal decking with a fall hazard of approximately 10-feet. The employees were unable to distinguish between the requirements noted in Subpart M (fall protection) and Subpart R (steel erection). ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.
