29 CFR  1910.178(l)(1)(i):  The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a) At 556 Governor Treutlen Circle, Pooler, GA 31322, on or about June 23, 2023, the employer exposed employees to struck-by hazards in that an employee was allowed to operate a rough terrain, extended boom forklift around other employees, without any training or evaluation demonstrating the knowledge and skills required to operate a powered industrial truck.

29 CFR  1910.178(m)(5)(i):When a powered industrial truck is left unattended, load engaging means were not fully lowered, controls were not netralized, power was not shut off, and brakes set:  a)  At 556 Governor Treutlen Circle, Pooler, GA 31322, on or about June 23, 2023, the employer exposed employees to struck-by hazards in that a rough terrain, extended boom forklift was allowed to be left unattended, with a load of 4ft by 8ft plywood lifted and extended to the roof, over 25 feet high, while employees walked and worked below.

29 CFR  1926.102(a)(1):  The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles:  a)  At 556 Governor Treutlen Circle, Pooler, GA 31322, on or about June 23, 2023, the employer exposed employees to struck-by hazards, in that the employer allowed his employees to operate pneumatic nail guns without eye protection.  Mejia Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.102(a)(1), which was contained in OSHA inspection number 1635368, citation number 1, item number 2 and was affirmed as a final order on May 3, 2023, with respect to a workplace located at 66 Saussy Road, Port Wentworth, GA 31407.  Mejia Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.102(a)(1), which was contained in OSHA inspection number 1340014, citation number 2, item number 2 and was affirmed as a final order on March 6, 2019, with respect to a workplace located at 154 Ristona Dr., Lot 291, Savannah, GA 31419.

29 CFR  1926.501(b)(13):  Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a)  At 556 Governor Treutlen Circle, Pooler, GA 31322, on or about June 23, 2023, the employer exposed employees to fall hazards greater than six feet, in that the employer allowed his employees to perform framing and decking activities, at a height of 20 feet, without using fall protection.   Mejia Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.501(b)(13), which was contained in OSHA inspection number 1635368, citation number 1, item number 2 and was affirmed as a final order on May 3, 2023, with respect to a workplace located at 66 Saussy Road, Port Wentworth, GA 31407.
