29 CFR  1910.178(a)(4):Modifications or additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:  a) Haviland Plastic Products, Co. located at 119 Main Street, Haviland, Ohio: On or about June 22, 2023, the employer failed to ensure that modifications such as the CAM fork attachments (2900 x 600; #82109787) to the Hyster Fortis FT120 forklift were approved by the powered industrial truck manufacturer or qualified registered professional engineer.  Employees tasked with the use the aforementioned forklift in conjunction with the CAM fork attachments to remove a hydraulic unit platform from Line 1 were exposed to hazards associated with overloading  and loss of stability.

29 CFR  1910.178(o)(1):The employer did not ensure that only stable or safely arranged loads were handled:  a) Haviland Plastic Products, Co. located at 119 Main Street, Haviland, Ohio: On or about June 22, 2023, the employer failed to ensure that the hydraulic unit platform load from Line 1 was safety arranged or stable prior to being handled by the Hyster Fortis S120FT forklift.  The unstable hydraulic unit platform load, weighing approximately 3,500lbs, fell from the forks of the Hyster Fortis 120 forklift from approximately twelve feet above the floor below and struck an employee causing head injuries that resulted in a hospitalization.
