29 CFR  1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered:  a. Concast Birmingham, Inc. - Wakeman, Ohio:  On or about June 22, 2023, the employer did not ensure that furnace operators, and those who accessed the furnace area, were provided with and wore protective equipment that would protect against burns from molten aluminum to the torso, arms, and legs.  Employees working at the furnaces were exposed to severe thermal burns from molten aluminum splash in that clothing did not protect against molten non-ferrous metals.   b.  Concast Birmingham, Inc. - Wakeman, Ohio: On or about June 22, 2023, the employer did not ensure that employees who are required to wear a Powered Air Purifying Respirator (PAPR) were protected from molten metal and sparks which could be trapped against the body by the PAPR.  Employees working at the furnaces were exposed to burn injuries.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR  1910.132(d)(1)(i): When the employer had assessed the workplace hazard(s) and determined that hazard(s) were present, the employer did not select and/or use the types of personal protective equipment that would protect the affected employee from the hazard(s).  a. Concast Birmingham, Inc. - Wakeman, Ohio: On or about June 22, 2023, the employer did not perform an adequate hazard assessment which would necessitate the proper protective equipment to be worn by employees exposed to hazards associated with molten nonferrous metal.  Furnace operators and employees who accessed the furnace deck did not wear clothing which would protect from burn injuries to the body.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
