A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees; a) On or about 7/12/2023 at water line project located at Abbott Road and Barlow Avenue, Lackawanna, New York ; employees were in an excavation to replace a water main down Abbott Road. Employees were working in an area approximately 5'-6" to 6'-0" deep without a ladder or other proper means of egress/access. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.652(a)(1): 29 CFR 1926.652(a)(1) Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): a) On or about 7/12/2023 at water line project located at Abbott Road and Barlow Avenue, Lackawanna, New York ; employees were in an excavation to install a new water line. The depth of excavation varied between approximately 5'-6" and 11'-0" deep with walls not adequately sloped and not properly protected from cave-ins. NO ABATEMENT CERTIFICATION REQUIRED E & R General Construction, Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1584484, citation number 1, item number 3 and was affirmed as a final order on 8/8/2022, with respect to a workplace located at Cottage Row, Lily Dale, New York.
