29 CFR 1910.147(c)(1):The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: a) BR Pallet, Inc. located at 21395 Hancock Ct. Rd 7 in Alvada, Ohio: On or about July 14, 2023, the employer failed to ensure an energy control program consisting of control procedures, employee training and periodic inspections were developed and performed. Employees tasked with performing service and maintenance activities such as, but not limited to, replacing saw blades on the PRS Group Inc pallet dismantler machine (SN: 3591) were exposed to amputation hazards created by the machines rotating saw blades and unexpected start up of the equipment.

29 CFR 1910.178(l)(2)(ii):The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace. a) BR Pallet , Inc. located at 21395 Hancock Ct. Rd 7, Alvada, Ohio: On or about July 14, 2023, the employer failed to ensure that each employee tasked with operating powered industrial vehicles such as, but not limited to, the Mitsubishi forklift (Model: FG25N) were adequately trained through a combination of formal instruction, practical training and evaluation prior to operating the powered industrial vehicles throughout the worksite. Power industrial vehicle operators and pedestrians were exposed to potential struck-by and crushing hazards in that employees operated the vehicles without the benefit of documented training.

29 CFR 1910.132(f)(1):The employer did not provide training to each employee who is required by this section to use personal protective equipment: a) BR Pallet, Inc. located at 21395 Hancock Ct. Rd 7, Alvada, Ohio, 44802: On or about July 14, 2023, the employer failed to provide training on proper selection, maintenance and usage of personal protective equipment. The employer required steel toed footwear and safety glasses to be worn by employees tasked with work activities such as, but not limited to, changing propane tanks on powered industrial vehicles, operating the Pallet Dawg pallet dismantler, PRS (trim saw,) and pneumatic nail guns without the benefit of adequate training prior to engaging in the aforementioned work activities.
