29 CFR  1910.22(a)(1): The employer failed to ensure all places of employment, passageways, storerooms, service rooms, and walking-working surfaces are kept in a clean, orderly, and sanitary condition.  On or about July 14, 2023, the employer failed to keep working surfaces including in and around the enclosure-less dust collection system for the Model AX Baker Saw and the dust collection system for the Smart Brand Chop Saw clear of combustible wood dust created from sawing and pallet deconstruction operations, exposing employees working in and around the Saw and Pallet Tear Apart buildings to potential fire and explosion hazards.

29 CFR  1910.95(k)(1): The employer failed to train each employee who is exposed to noise at or above an 8-hour time weighted average of 85 decibels in accordance with the requirements of this section. The employer shall institute a training program and ensure employee participation in the program.  On or about July 14, 2023, the employer failed to maintain employee training as part of their hearing conservation program for all the employees working inside of the production buildings including the Saw, Pallet Tear Apart, and Maintenance where they are exposed to over 85 decibels across an 8-hour time weighted average. Working inside of these production buildings include construction and dismantling parts of the pallets that would expose the employees to loud noise.

29 CFR  1910.1200(h)(1): The employer failed to provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.  On or about July 14, 2023, the employer failed to develop, maintain, and implement a written training program for employees that check and handle hazardous chemical (HAZCOM) products including operations that include changing out propane tanks and other types of fuel and fluids for forklifts and other Powered Industrial Vehicles (PIVs).
