29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, are not protected by protective helmets: (a) The employer is failing to protect each employee working in areas where there is a possible danger of head injury from impact or falling or flying objects. This practice led to employees being unprotected from head injuries on July 17, 2023, where they were working below re-roofing operations where there was a danger of head injury from impact and falling or flying objects at 20454 E Hampden Place, Aurora CO 80013. Employees were not protected by protective helmets. To abate this violation, the employer must come into compliance with this standard at all of its job sites to ensure that no employees enter areas below active roofing operations until protection is provided. Abatement Note: Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including an explanation of how these steps protect its employees from the hazards of falling or flying object hazards. (An abatement plan, periodic progress reports, and provision of site addresses may be required if the abatement period is more than 90 days.)

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder is not secured at its top to a rigid support that will not deflect, and/or a grasping device is not provided to assist employees in mounting and dismounting the ladder: (a) The employer is failing to ensure that a portable extension ladder used to access upper-level roofs, had side rails that extended three feet above the upper landing or was secured. This practice led to employees being unprotected from fall hazards on July 17, 2023, while engaging in re-roofing operations on a residential building at 20454 E Hampden Place, Aurora CO 80013 and were exposed to a fall of 7.8 feet where the ladder did not extend three feet above the landing surface and was not secured to a rigid support. To abate this violation, the employer must come into compliance with this standard at all of its job sites to ensure ladders are safely erected for access/egress and extend at least three feet above the roof line. Abatement Note: Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including an explanation of how these steps protect its employees from the hazards of falls from ladders. (An abatement plan, periodic progress reports, and provision of site addresses may be required if the abatement period is more than 90 days.)

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels is not protected by guardrail systems, safety net system, or personal fall arrest system, nor are employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): (a) The employer is failing to protect each employee performing work 6 feet or more above lower levels from fall hazards by using appropriate guardrail systems, safety net system, or personal fall arrest systems as required by 1926.501(b)(13). On or about July 17, 2023, and at times prior, this practice led to the employer not protecting employees who were required to engage in re-roofing operations on a residential building at 20454 E Hampden Place, Aurora CO 80013 from exposure to fall hazards in excess of 6 feet. To abate this violation, the employer must come into compliance with this standard at all of its job sites to ensure employees engaged in residential construction activities above six feet are utilizing a fall protection system before roofing activities begin. Sky Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1636644, citation number 1, item number 1, and was affirmed as a final order on March 6, 2023, with respect to a workplace located at 8223 W Floyd Ave, Denver, CO 80227. Sky Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1556957, citation number 1, item number 1, and was affirmed as a final order on February 24, 2022, with respect to a workplace located at 19588 W 60th Lane & 19589 W 59th Drive, Golden, CO 80403. Sky Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1545029, citation number 1, item number 1, and was affirmed as a final order on December 28, 2021, with respect to a workplace located at 1472 Meadow Peak View Colorado Springs, CO 80906.
