29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a. On or about July 19, 2023, at the above addressed jobsite, employees performing residential carpentry operations, twenty-one (21') feet four (4) inches above the ground, were not protected from falls, thereby exposing employees to fall hazards.  Five Star Highland Builders, Inc. was previously cited for a violation of this occupational safety and health standard 29 CFR  1926.501(b)(13), which was contained in OSHA inspection number 1398062, citation number 2, item number 1 and was affirmed as a final order on November 19, 2019, with respect to a workplace located at 830 Park Ave., River Forest, IL 60305.  Five Star Highland Builders, Inc.  was previously cited for a violation of this occupational safety and health standard 29 CFR  1926.501(b)(13), which was contained in OSHA inspection number 1657551, citation number 2, item number 1 and was affirmed as a final order on July 6, 2023, with respect to a workplace located at 29 N. Washington, Westmont, IL 60559.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:(a)  a. On or about July 19, 2023, at the above addressed jobsite, the portable ladder used to access the garage roof did not extend at least three (3) feet above the upper landing surface, thereby exposing employees to the hazards associated with falls.  Five Star Highland Builders, Inc. was previously cited for a violation of this occupational safety and health standard 29 CFR  1926.1053(b)(1), which was contained in OSHA inspection number 1657551, citation number 3, item number 1 and was affirmed as a final order on July 6, 2023, with respect to a workplace located at 29 N. Washington, Westmont, IL 60559.
