29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a.  On or about August 14, 2024, at the above addressed jobsite, an employee required to operate a JLG SKYTRAK Model 6036 Powered Industrial Vehicle (PIV) had not been trained and evaluated on the safe operation of the powered industrial truck, thereby exposing employees to vehicle tip-over, struck-by, and crushed-by hazards.

29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied:  a.  On or about August 14, 2024, at the above addressed jobsite, an employee performing carpentry framing operations from a platform raised, approximately twelve (12) feet above ground, by the forks of a JLG SKYTRAK Model 6036 Powered Industrial Vehicle (PIV), did not have the platform attached to the forks, thereby exposing the employee to fall hazards.
