29 CFR  1926.100(a):Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a)	Joaquin Tovar Perez. On or about August 2, 2023 at the address of 448 Miami St. Tiffin OH 44883: The employer did not ensure that employees were protected from head injury hazards by protective hardhats while working on the ground below the roof line, as employees above actively removed old roofing materials. Employees operating in this condition were exposed to struck by injuries from falling/flying objects such as tools and roofing materials.

On or about August 2, 2023 at the address of 448 Miami St. Tiffin OH 44883: The employer did not ensure each affected employee used appropriate eye or face protection while utilizing pneumatic nail guns during roofing work activities on residential structure. Employees working in this condition were exposed to potential struck by hazards (flying projectile/ricochet nails).

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)	Joaquin Tovar Perez. On or about August 2, 2023 at the address of 448 Miami St. Tiffin OH 44883: The employer did not ensure employees were protected from falls while performing roofing work activities (installing shingles) atop a two-story residential structure with an 8 -12 roof pitch. Employees operating in this condition were exposed to falls of  between 19ft - 25ft to the ground below.  Joaquin Tovar Perez was previously cited for a violation of this Occupational Safety and Health Standard 1926.501(b)(13), which was contained in OSHA inspection number 1606499, citation number 1, item number 1 and was affirmed as a final order on August 31, 2022, with respect to a workplace located at 1018 Boone Ct. Bowling Green OH 43402.
